Withdrawal period

In accordance with France's Consumer Code (articles L121-21 to L121-21-8) customers have 14 days to return purchases, with the exception of goods made at the customer's request or goods which are clearly personalized. All costs including delivery costs are reimbursed. Return costs are the customer's responsibility.

Estimate

The submission of a price estimate only constitutes a commitment for immediate execution if it is followed by the signing of a purchase order.

Our quotes - as well as photos, drawings and articles - remain our property, and may not be reproduced or distributed without authorization. Quotes are established free of charge, except for extended consultation.

Price

The prices of our quotes and tariffs are given for information only, excluding delivery, unless referenced on the quote. They only become final once the estimate has been signed and returned by the customer. Prices must be increased by VAT at the rate in force at the time of delivery. For any delivery requiring special packaging, the costs must be subject to a specific quotation.

Orders

Orders only become final and binding upon receipt of the purchase order or and following the confirmation of products, quantities, prices, delivery times and details and terms of payment, receipt of payment or the agreed deposit (if applicable) and acceptance by the customer of general terms & conditions of sale.

Order Changes

We can accept changes to final orders only subject to stock/production and on the condition that the requested changes do not entail any renewal of contractual relationships.

We reserve the right to charge our clients beforehand for additional costs and care.

Restocking

We cannot guarantee the restocking of orders.

Delivery times

Delivery times are only given as an indication and are dependent on suppliers and carriers. Delivery times can therefore be modified by circumstances beyond our control.

Any delays in delivery cannot constitute a cause for cancellation of the order or give rise to a right to compensation.

Delivery and shipping

Deliveries take place in accordance with legal provisions. Remember to check access for delivery. We reserve the right to choose the most appropriate means of delivery for the order.

It is the responsibility of our customers to check the condition of goods on delivery and to make any reservations and protests to the carrier if necessary; otherwise, no claim can be accepted.

Complaints

Any complaints about quantitative or qualitative differences must be communicated to us within 24 hours of delivery.

Otherwise, no claim can be accepted, except the legal guarantee of defects or hidden defects.

A brief explanatory text and a photo must be sent to us by e-mail (hello@bahiadunham.fr).

Payment

Our invoices are domiciled and payable at our head office and/or at our branch in Paris (being set up), regardless of the payment instrument.

They are stipulated to be payable net, without retention of guarantees or other.

The agreed terms of payment constitute a substantial condition of our contractual relations.

Any delay in payment entails the invoicing of late payment interest at the rate of advances on securities from the Banque de France increased by four points, and immediate payment of future payments by loss of the benefit of the term, even though it would be staggered delivery orders.

Retention of title

Our goods remain our property until full payment of the price and any interest on late payment (law of 12 May 1980) and therefore cannot be moved, rented or resold, nor pledged without our agreement.

Disputes

All disputes will be the exclusive jurisdiction of the Commercial Court of PARIS, notwithstanding any contrary clauses appearing on the commercial papers of our customers.
